Sex Charges Range in Severity
Like with most crimes, sex crimes can vary in severity, meaning punishments vary as well. If accused of a sex crime, you will be punished based on alleged factors such as how much harm was caused during the incident, whether violence was used, how many prior offenses you have on record, and so on.
Sex crimes include:
- Sex trafficking
- Internet solicitation of minors
- Indecent exposure
Categories of sexual assaults:
- First, second, third degrees are chargeable as a felony
- Fourth-degree sexual assault is chargeable as a misdemeanor
Most sexual assault convictions require lifetime registration as a sex offender, which of course can have a massive negative impact on a person’s life. People convicted of sex crimes can suffer life-altering consequences, including lifetime sex offender status and prison time.
It is necessary to consider Hawaii’s tourist trade in understanding cases of sex trafficking, a federal crime that carries significant consequences, in the state. The prostitution industry follows the sun, so there is an increase in prostitution during the winter—and consequently, prostitution-related cases and incidences of sexual assault.
Myles S. Breiner Attorney at Law provides strong legal representation for dozens of prostitution and solicitation for prostitution cases in Hawaii each year.
Punishments for Sex Crimes in Hawaii
In Hawaii, there are four classes of sex crimes—first to fourth-degree. First-degree sex crimes are the most serious and fourth-degree crimes the least. For example, knowingly engaging in sexual penetration with a person 14 years of age or younger is a first-degree offense whereas purposefully exposing genitals to another person would likely be considered a fourth-degree crime.
The breakdown of potential punishments is as follows:
- First-degree sexual assault/Class A felony: Punishable by up to 20 years of imprisonment and a fine of up to $50,000.
- Second-degree sexual assault/Class B felony: Punishable by up to 10 years of imprisonment and a fine of up to $25,000.
- Third-degree sexual assault/Class C felony: Punishable by up to five years of imprisonment and a fine of up to $10,000.
- Fourth-degree sexual assault/Misdemeanor: Punishable by up to one year in jail and a fine of up to $2,000.
To help you avoid these, our Honolulu sex crimes defense attorney will build a defense based on your unique situation and needs to help you fight the charge. Our main goal is to secure the lightest possible sentence, if not have your charges dropped altogether. We are happy to assist with criminal appeals as well.
