What Is A Felony?

A felony as a crime punishable by more than one year in prison. Common felonies include sexual assaults, drug crimes, and white-collar crimes.

These cases are divided into three classes:

  • Class A — The most serious crimes; these are punishable by 20 years to life in prison.
  • Class B — These crimes are punishable by a maximum of 10 years in prison.
  • Class C — The lowest class of felonies mandates a maximum of five years in prison.

Methods Used in Charging Felonies
Felonies are charged using three different methods in Hawaii. These methods are:

  • A preliminary hearing — After you are arrested, the prosecutor files a complaint. The prosecutor must present evidence that illustrates probable cause that you committed a crime.
  • A grand jury indictment — This is a closed-door proceeding in which a grand jury examines the evidence and determines if there is sufficient probable cause to charge you with a crime. If the grand jury returns an indictment, a warrant will be issued for your arrest.
  • Information charging — In this case, a judge determines if there is probable cause based on information provided in an affidavit.
